Northbound Collegiate disclaims all liability for disciplinary actions, rejection of applications, rescission of offers, or sanctions imposed as a result of client misuse of our Services.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NORTHBOUND COLLEGIATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES. THIS INCLUDES BUT IS NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF TWO HUNDRED FIFTY DOLLARS ($250) OR THE AMOUNT ACTUALLY PAID BY YOU TO NORTHBOUND COLLEGIATE FOR SERVICES DURING THE SIX-MONTH PERIOD PRECEDING THE CLAIM.
10. California Civil Code 1542 Waiver
By agreeing to these Terms, you expressly waive the protections of Section 1542 of the California Civil Code, which states: “A general release does not extend to claims that the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.” You understand and acknowledge that this waiver applies to unknown and unsuspected claims, and you voluntarily assume the risk that such claims may exist.
11. Indemnification
You agree to indemnify, defend, and hold harmless Northbound Collegiate and its affiliates, directors, officers, employees, contractors, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to your use of the Services, your violation of these Terms, your User Content, or your infringement of any rights of third parties.
12. Dispute Resolution and Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules.
